These Terms and Conditions ("Terms") govern your access to and use of bathelevate.com (the "Site") and the quote-matching services offered on it (collectively, the "Services"), operated by Poshnee Tech LLC d/b/a Bath Elevate ("Bath Elevate," "we," "us," or "our").

By submitting a form on the Site, calling any number listed on the Site, or otherwise using the Services, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, do not use the Site or Services.

1. Description of Services

Bath Elevate is a marketing and lead-referral platform. We are not a bathroom remodeling contractor, general contractor, or home improvement company, and we do not perform, supervise, warrant, or guarantee any installation, remodeling, or construction work. When you submit a request through our Site, we forward your contact information and project details to up to four (4) independent, third-party contractors ("Partner Contractors") who may contact you directly to discuss pricing, scheduling, and performance of the requested work.

2. Eligibility

You must be at least 18 years old and have the legal authority to request home improvement quotes for the property in question to use the Services. By using the Site, you represent that you meet these requirements.

3. Consent to Be Contacted

By submitting the quote request form and checking the consent checkbox, you expressly agree that Bath Elevate and up to four Partner Contractors may contact you at the phone number and email address provided — by telephone call, SMS/text message, email, or prerecorded/autodialed message — regarding your request, even if your number is on a state or federal Do-Not-Call registry. Consent is not a condition of purchasing any goods or services, and message/data rates may apply. You may revoke this consent at any time as described in our Privacy Policy.

4. Accuracy of Information

You agree to provide accurate, current, and complete information when submitting a request. We are not responsible for delays or failures in matching you with a Partner Contractor caused by inaccurate or incomplete information you provide.

5. No Guarantee of Match or Pricing

We do not guarantee that:

• Your ZIP code or project will be serviced by a Partner Contractor;
• Any specific number of contractors will contact you;
• Any quote received will match pricing, promotions, or estimates displayed on the Site, which are illustrative only and subject to change based on an in-home assessment; or
• Any Partner Contractor will complete work within a particular timeframe or to a particular standard.

6. Relationship with Partner Contractors

Partner Contractors are independent businesses, not agents, employees, franchisees, or joint venturers of Bath Elevate. We conduct no more than basic vetting (such as confirming business licensing where reasonably available) before referring leads, and we do not warrant the quality, safety, licensing status, insurance coverage, workmanship, or business practices of any Partner Contractor. Any dispute regarding pricing, workmanship, scheduling, warranties, or payment must be resolved directly between you and the Partner Contractor.

7. Intellectual Property

All text, graphics, logos, and other content on the Site are owned by or licensed to Poshnee Tech LLC and are protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the Site without our prior written consent.

8. Prohibited Conduct

You agree not to:

• Submit false, fraudulent, or duplicate quote requests;
• Use the Site for any unlawful purpose or in violation of these Terms;
• Attempt to interfere with, disrupt, or gain unauthorized access to the Site or its underlying systems;
• Scrape, harvest, or collect data from the Site using automated means without our consent;
• Impersonate any person or misrepresent your affiliation with any person or entity.

9. Disclaimer of Warranties

The Site and Services are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure, or that any information on the Site is accurate, complete, or current.

10. Limitation of Liability

To the fullest extent permitted by law, Poshnee Tech LLC, its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or relating to your use of the Site or Services, or any interaction, contract, or dispute with a Partner Contractor, even if advised of the possibility of such damages. Our total aggregate liability for any claim arising from these Terms or the Services will not exceed one hundred U.S. dollars ($100).

11. Indemnification

You agree to indemnify, defend, and hold harmless Poshnee Tech LLC and its officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Site, your violation of these Terms, or your dealings with any Partner Contractor.

12. Third-Party Links and Content

The Site may contain links to third-party websites, including those of Partner Contractors. We do not control and are not responsible for the content, privacy practices, or terms of any third-party site.

13. Governing Law and Dispute Resolution
